Our firm represents clients in both contested and uncontested divorces. Uncontested divorces are the simplest matters to handle. These cases occur when both spouses want an amicable parting and have essentially already come to an agreement regarding issues of alimony and child custody. Even in this situation, it’s important for each party to hire their own attorney. An attorney will make sure the agreement is properly memorialized and filed with the court. We can also review the agreement to ensure that no unintentional mistakes have been made that can cause future tax or inheritance problems. This is particularly important in high net-worth divorces and cases in which parties signed prenuptial agreement.

We are frequently able to reach negotiated settlements on behalf of our clients in contested divorces. While we are prepared and able to take these matters to court, we believe that engaging in assertive mediation is almost always superior to the painful process of litigating family matters in court.

As part of our divorce practice, we also work with clients to create child custody and child support plans that work for the entire family. In New York, there are two parts to child custody, legal and physical. Legal custody refers to the ability to make important decisions on behalf of the child. Physical custody describes where the child lives. Both parents can have joint or sole custody. Visitation arrangements are part of the physical custody arrangement. If a divorce goes to court, a judge will make a ruling on these matters. An important part of our practice is negotiating child custody and child support agreements.
